Standard Copyright and License Terms

All images taken by or on behalf of Richard's Photography remain the sole property of Richard Higham. It is an offence to copy or reproduce images without the express written consent of Richard's Photography.

Unless otherwise specified, photographs supplied to a client following a photoshoot may be used as follows by the client:

  • The client may make further copies (either electronic or printed) of the image(s) for personal use. (This explicitly forbids use for commercial reasons or to support a campaign, such as a political campaign, or use by a third party.)
  • The client may use pictures online, on social media websites or other websites subject to the restrictions above relating to commercial use and campaigns.

If a picture is provided free-of-charge (for example a sample or complimentary photograph), permission is granted to use the image as specified above, except that if the image is used online, text should be included similar to 'Photography by Richard Higham, Richard's Photography © 2020: used by permission.'

Images may not be sold to another person or business without the express written consent of Richard's Photography.

If an image is used in printed material (such as a magazine or a book), or as part of an online article relating to the client, text should be included similar to 'Photography by Richard Higham, Richard's Photography © 2020: used by permission.' However, permission excludes any articles where the client (or a third party) receives payment for the item.

Richard's Photography reserves the right to take action against copyright infringements.

Commercial Use

All commercial use of photographs (including selling of images or use of images in return for payment) is not included in the standard photoshoot prices. Clients wishing to use images for commercial purposes should contact Richard before the photoshoot to explain their requirements.

If a client wishes to use an image for commercial purposes after a photoshoot (where the use in question was not agreed in advance), permission from Richard's Photography is required. This may involve making additional payment.

Richard's Photography reserves the right to take action against copyright infringements.

Cancellation

More than seven days (excluding the day of the planned photoshoot): refund of deposit.

Less than 24 hours: full payment required (excluding any travel costs or editing costs).

Between 24 hours and seven days (excluding the day of the planned photoshoot): loss of deposit.

If payment has been made to a third party (for example to hire equipment or a venue), any costs incurred remain the responsibility of the client.

Changing a Photoshoot

If the client wishes to postpone and rearrange a photoshoot, Richard's Photography will endeavour to accommodate such a request. This includes a change of venue or type of photoshoot.

If payment has been made to a third party (for example to hire equipment or a venue), any costs incurred by the changes are the responsibility of the client.

Payment

Unless otherwise agreed in writing, payment is required before a photoshoot taking place or additional work (for example, editing) being undertaken. If payment is deferred, clients do not have permission to use any images before making full payment.

Disputes

To avoid disputes, the client should discuss their requirements before payment and/or the photoshoot.

Richard's Photography aims to provide a high level of service proportionate to photography charges. If you are not satisfied with the images produced, Richard's Photography would like the opportunity to review the photos and consider further editing or additional photography.

In exceptional circumstances, a refund may be given. In these circumstances, printed copies of photos should be returned and electronic copies deleted. No permission is granted for any use of the photograph(s) in these circumstances.

Any use of the photos will constitute acceptance of the quality of the work undertaken.

As part of running a small business Richard’s Photography collects necessary data from clients to manage and process bookings, and maintain accounts and records. The company only holds information for advertising, marketing and public relations in connection with its core business; this may include past, existing or present customers or suppliers.
As Richard’s Photography only processes personal data for core business purposes, it is exempt from registration with the Information Commissioner’s Office (ICO).

What type of information we have:
We currently collect and process the following information: name and contact details, details of bookings and invoices/payments, hobbies, interests, preferences, and the collection of photographs taken during photoshoots or provided by subjects.

How we get the information and why we have it:
The personal information we process is provided to us directly by you for one of the following reasons: to facilitate running a photo shoot (including taking suitable pictures based on information about you such as interests or hobbies), bookings, invoicing and payments.
On some occasions, we also receive personal information indirectly, for example when a third party makes a booking on your behalf.

Under the General Data Protection Regulation (GDPR), the lawful bases we rely on for processing this information are:

  • Your consent. (You are able to remove your consent at any time. You can do this by contacting us using the details above.)
  • We have a contractual duty.
  • We have a legitimate interest.

What we do with the information we have:
We use the information that you have given us in order to organise and run a photoshoot and to produce invoices and take payment.
We will only share this information (in part or in full) if there is a legal duty to do so, or if we have your clear written or electronic consent.

How we store your information:
Your information is securely stored on a secure private server.
Unless you give written or electronic consent we keep your personal data for a maximum period of 18 months. We will then dispose your information (or the parts for which you have not given consent) by erasing it from our servers (including the back up server).

Your data protection rights:
Under data protection law, you have rights including:
  • Your right of access - You have the right to ask us for copies of your personal information.
  • Your right to rectification - You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
  • Your right to restriction of processing - You have the right to ask us to restrict the processing of your information in certain circumstances.
  • Your right to object to processing - You have the right to object to the processing of your personal data in certain circumstances.
  • Your right to data portability - You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
